The Constitution ensures only that government workers may not be punished or fired because they belong to a union.

Yet government employees are expected to shape and adapt their lives in ways not required of the rest of the workforce. This book begins by identifying and explaining some of those differences. May government deny a person a job on any ground or for any reason it chooses? No. It is true that government does not "owe" any person a job, and no citizen has a constitutional right to a job. But a public agency that hires workers must consider every applicant on the basis of its needs and his or her qualifications.

The answer probably depends both on the nature of the position and on the applicable policy regarding the use and dissemination of criminal records. Occasionally the assessment of an applicant for a sensitive position may include a review of arrest records. But courts seem increasingly reluctant to permit wholesale inquiry into such files, and recent decisions suggest Page 23 a diminishing level of acceptable government scrutiny of such records. Meanwhile states have increasingly addressed this issue through legislation in different ways.
