The relative insignificance of the consent agreement made the pretense palatable and developed the board’s taste for misinformation, as truths about the leadership’s conduct became harder and harder to swallow: board members who initially dismissed Romero’s “fibs” about a minor governance issue as harmless errors could not so easily have ignored evidence that he lied to them about betraying a core organizational principle—our opposition to post-9/11 watch lists. But eventually they would ignore and even defend that betrayal, when we found out that Romero had quietly signed a contract with the government promising to use the watch lists to screen employees.

Staff had reportedly been warned not to reveal the existence of the data-mining initiative to board members, but given the board’s passivity, the secrecy surrounding the program may have been quite unnecessary. The reaction to the Times story by national and affiliate board and staff members demonstrated the failures of oversight that prompted the leak to the press. ) Exposure of the datamining program was treated as another public relations crisis and resulted in another furious round of questionable and sometimes contradictory claims and counterclaims by the leadership, along with accusations that the Times report was false and misleading (although, as far as I know, the ACLU did not request corrections and the Times did not revise its account).

Neither I, nor other critics, were demanding Romero’s dismissal. I wanted a reason to believe that we could trust him in the future. I wanted an acknowledgment of the truth. But his most ardent defenders on the executive committee apparently feared that investigating and acknowledging the truth of his conduct would inevitability require replacing him. They were the first to raise, and exploit, the possibility of firing Romero—a possibility the board did not want to confront. Instead, it acted on the pretense that the new executive director had made a few innocent mistakes and his critics were “hounding” him out of an excess of prosecutorial zeal or personal animus: “I do not see ‘mismanagement’ or ‘deception’ here,” one wendy kaminer 23 of Romero’s staunchest defenders on the board explained to me in a private e-mail months later, summarizing the unofficial party line: “I see a ‘Golden Boy’ who has made relatively few mistakes in his youth, probably covered them up in ways that you or I might not think were the best, and is learning how to deal in an arena that demands more transparency than he is used to.
